Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the opencomm website, onboarding, and community (“Service”), operated by Openhearted Inc. (“Openhearted”, “we”, or “us”). By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

The Service is intended for professionals aged 16 and older. You must provide accurate account information and keep it current. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Accounts are personal and may not be transferred to another person.

opencomm is a give-first community. As a member, you agree to:

• Treat other members with respect and professionalism.
• Contribute help, feedback, and knowledge before asking for favors.
• Represent your skills, experience, and identity honestly.
• Respect the confidentiality of what members share within the community.

You agree not to:

• Harass, discriminate against, spam, or defraud other members.
• Post unlawful, misleading, or infringing content, or content you do not have the right to share.
• Send unsolicited mass messages, promote unrelated products, or scrape member data.
• Use the Service to generate artificial engagement or misrepresent any relationship or endorsement.
• Attempt to gain unauthorized access to the Service, other accounts, or member data.

The opencomm community operates on Slack, governed by these Terms as well as Slack’s own terms and policies. We may moderate, remove content, suspend, or remove any member who violates these Terms or whose behavior harms the community, at our sole discretion.

The Service generates AI-assisted summaries from the profile information you provide. These summaries are provided for convenience, may contain errors, and do not represent statements by Openhearted. You are responsible for reviewing and, if needed, correcting your own profile and summary.

opencomm exists to help professionals connect, collaborate, and create opportunities. Openhearted does not guarantee employment, job offers, interviews, referrals, income, or any specific professional outcome as a result of joining the Service. Hiring decisions made by third parties, including other members and employers, are entirely their own.

You retain ownership of the content you submit to the Service. By submitting content, you grant Openhearted a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display it solely as needed to operate and improve the Service. You are solely responsible for the content you submit and confirm you have the rights to share it.

The Service, including its design, text, graphics, and branding, is owned by Openhearted Inc. and protected by intellectual property laws. You may not copy, modify, or distribute the Service or its content without our prior written permission, except for your own content as described in Section 7.

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that interactions between members will be safe or satisfactory. You interact with other members at your own risk.

To the maximum extent permitted by law, Openhearted Inc. and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, opportunities, data, or goodwill, arising from or relating to your use of the Service. Our total aggregate liability for any claim will not exceed USD 100 or the amount you paid us in the 12 months preceding the claim, whichever is greater.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service, with or without notice, if you breach these Terms or if we reasonably believe it is necessary to protect the community or the Service. Sections 9, 10, and 12 survive termination.

These Terms are governed by the laws of the jurisdiction in which Openhearted Inc. is incorporated, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be resolved exclusively in the courts of that jurisdiction, except where applicable law provides otherwise.

We may update these Terms from time to time. When we make material changes, we will notify members by email or through the Service and update the effective date above. Continued use of the Service after changes take effect means you accept the updated Terms.
